TERMS AND CONDITIONS
Northern Masailand Safaris (hereinafter referred to as “the Company”) accepts bookings subject to the terms and conditions outlined below.


1. Booking Conditions

Bookings and subsequent contracts shall be deemed to have been concluded in Arusha, Tanzania, and shall be interpreted according to the laws of the United Republic of Tanzania. The place of jurisdiction is Arusha, Tanzania.The company reserves the right to decline any booking without outlining the reasons for it.

Force majeure
In these booking conditions, force majeure means any event which we or the supplier of services in question could not even with all due care foresee or avoid. Such events are likely to include, but are not limited to, war, threat of war, civil strife, riot, civil disorder/unrest, industrial dispute, actual or threat of terrorist activity, natural or nuclear disaster, fire, floods, breakout of an epidemic or pandemic disease, technical problems with transport, cancellation or amendment to any scheduled flight, closure or congestion of airports or ports, adverse conditions and all similar events outside our control.


2. Deposit and Payment

A deposit of 50% is required to secure a booking. This deposit forms part of the total payment and will be offset against the final amount due.Full payment must be received: at least 4 weeks (28 days) prior to departure for Scheduled Group Tours at least 45 days prior to departure for Private Safaris

If full payment is not received according to the above, the Company reserves the right to treat the booking as cancelled, in which case the deposit will be forfeited.

Clients booking within 28 days of departure for Scheduled Group Tours and 45 days of departure for Private Safaris are required to pay the full amount immediately to secure the reservation.

All bank charges, including transaction fees charged by our bank, are the responsibility of the client. The amount reflected on our invoice is the amount that must appear in our account for the booking to be considered fully paid.


3. Booking Amendments

For amendments of existing bookings done by the client (e.g., departure dates, air tickets, accommodation, number of participants etc) a handling fee of 50 USD per booking applies. The handling fee will be charged in addition to the service provider fees.


4. Cancellations

Cancellations must be sent in writing to the office that confirmed the reservation. Cancellations shall only be effective from the date of receipt of cancellation by the booking office. In case of a booking cancellation, the Company shall retain the full deposit. Please note that cancellation terms and conditions apply differently for specific bookings.

If a booking for a Scheduled Group Tour is cancelled, the client is subject to a cancellation fee as follows:

  • up to 28 days (4 weeks) before departure: 30% of the tour price

  • 27 to 14 days before departure: 50% of the tour price

  • 13 to 7 days before departure: 75% of the tour price

  • less than 7 days before departure: 90% of the tour price

If a booking for a private safari, such as a private guided safari, fly-in safari, or self-drive tour, is cancelled, the client is subject to a cancellation fee as follows:

  • up to 90 days prior to departure: 30% of the tour price

  • 89 to 45 days prior to departure: 50% of the tour price

  • less than 45 days prior to departure: 90% of the tour price


5.PASSPORTS, VISAS, AND OTHER TRAVEL PAPERS

It is the client’s sole responsibility to ensure that passports, visas, health certificates, proof of vaccinations, and any other documentation required are all in order for the countries to be visited.

The Company can not be held liable for any consequences, damages, or claims if the client does not attend correctly to the client’s documentation and related matters prior to commencement of the tour.


6. Baggage

At any time, all baggage and personal effects are at the client’s responsibility, and the Company does not accept any liability for any loss or damage of any personal effects, however arising.

Clients are entitled to one bag of not more than 15 kg (backpack or soft bag – no hardtop suitcase) and a daypack. The company reserves the right to refuse excess baggage. Please notice that on our trekking tours and on some “bush” flights, other baggage regulations may apply.


7. Risk

The client accepts that all tours are of an adventurous nature and involve an element of personal risk. Neither the Company nor any of its agents can be held liable in any way for any injury, loss of life or damage to property, howsoever caused. The client hereby indemnifies the company and will hold the company, its agent, assigns, and servants harmless from any such claim.

The client accepts full responsibility for all risks involved.


8. Authority on Tour

The decisions of the Company’s guide/driver on tour shall at all times be final and binding.

The client must at all times comply with the laws, custom,  and foreign exchange regulations of all countries visited.


9. Marketing and Media

The company reserves the right to use any photographs and videos taken during tours for marketing or any other advertising material. The client hereby gives consent to use such photographs and authorises the company to retain copyright for these photographs and such material.


10. Force majeure

In these booking conditions, force majeure means any event which we or the supplier of services in question could not even with all due care foresee or avoid. Such events are likely to include, but are not limited to, war, threat of war, civil strife, riot, civil disorder/unrest, industrial dispute, actual or threat of terrorist activity, natural or nuclear disaster, fire, floods, breakout of an epidemic or pandemic disease, technical problems with transport, cancellation or amendment to any scheduled flight, closure or congestion of airports or ports, adverse conditions and all similar events outside our control.


11. Price Changes

All our prices are based on the current national park fees and taxes. Should the authorities decide on increasing fees and taxes, even though they might currently not be scheduled, we would subsequently have to pass on these increases.
